PLEASE REVIEW THIS END USER LICENSE AGREEMENT (THIS 'AGREEMENT') CAREFULLY. This product is software, or contains software (including firmware), licensed to you by Linksys LLC, a wholly-owned subsidiary of Belkin International, Inc., or one of its subsidiaries or affiliates ('Linksys', 'us' or 'we') and by Linksys' suppliers. This Agreement sets forth the terms and conditions governing your use of any and all software and/or firmware incorporated in this product, excluding technology from the open source community (the 'Software'), including, without limitation, how you may use the Software, Linksys' responsibilities for how the Software will work, and your responsibilities relating to how you use the Software.

By 'you,' we mean the purchaser, recipient or other end user of a Linksys product (a 'Product') containing the Software or the purchaser, recipient or other end user of the Software on a standalone basis. 'You' may also mean a person that has downloaded the Software from an authorized website, such as http://linksys.com, or from an authorized application market or store, such as Apple's App Store or Google Play (collectively, authorized application markets and stores are referred to in this Agreement as 'App Stores').

If you have downloaded the Software from an App Store, you are also subject to any terms of use of that App Store. Such terms of use may prohibit you from doing some of the things you are permitted to do under this Agreement, or permit you to do some of the things you are prohibited from doing under this Agreement. In addition, application of the App Store's terms of use may result in other terms of this Agreement not being applicable to the Software or applying in a different way than this Agreement states. If your use of the Software is subject to an App Store's terms of use, then in the event of any conflict or ambiguity between the terms of this Agreement and such App Store's terms of use, the App Store's terms of use will govern, but only to the extent necessary to resolve such conflict or ambiguity, and the terms of this Agreement will otherwise remain in full force and effect. Notwithstanding anything to the contrary in this Agreement, by using the Software, you acknowledge and agree that it is solely your responsibility to understand the terms of this Agreement, as well as the terms of use of any App Store(s) that may be relevant to the Software or the Product.

What you may do:

Operate the Software in the manner described in the user documentation for the Software
Where the Software is provided for download onto a personal computer or mobile device, you can make as many copies of the Software as you reasonably need for your own use
Make a back-up copy of the Software
Permanently transfer all of your rights to use the Software to another person, so long as that person also agrees to be bound by this Agreement and following such transfer you thereafter stop using the Software

What you may not do, and what you may not permit others to do:

Modify the Product, the Software or user documentation (except as may be permitted by any applicable open source license) without receiving prior written consent from Linksys to modify
Lease, sublicense, resell, redistribute, or otherwise transfer (except as expressly permitted above), whether for commercial purposes or otherwise, the Software or user documentation
Reverse engineer, disassemble or decompile the Software or otherwise try to reduce the Software to a human-readable form, except where such activity is permitted by applicable law or where Linksys is required to permit such activity under the terms of an applicable open source license
Delete any copyright, trademark or other proprietary notices from the Software or user documentation
Use the Product, the Software or user documentation to develop a competing hardware and/or software product
If the Software is firmware, copy the firmware or operate it separately from the Product onto which it is embedded

Upgrades and Updates: While Linksys is not required to do so, Linksys may provide you with upgrades or updates to this Software. This Agreement covers any upgrades or updates to the Software you may obtain from Linksys, from one of its authorized resellers, retailers or distributors or from an App Store, unless the upgrade or update comes with its own license agreement. If you decide not to download an upgrade or update provided by Linksys, you understand that you could put the Software at risk to serious security threats or cause the Software to become unusable.

Data, Information and Privacy: At all times your information will be treated in accordance with either Belkin's Privacy Statement, which is incorporated by reference into this Agreement and can be viewed at: http://www.belkin.com/us/privacypolicy, or the Linksys Smart WiFi Privacy Statement, which is incorporated by reference into this Agreement and can be viewed by clicking on the 'Privacy Statement' link at the bottom of the Linksys Smart WiFi page available here: http://www.linksyssmartwifi.com .

Ownership: The Software is licensed, not sold, to you. Any rights that are not expressly granted to you under this Agreement are reserved to Linksys.

Third Party Products and Services: The Software may contain links or other features that make it easier for you to visit or log-in to independent third-party websites ('Linked Sites'). These features are provided solely as a convenience to you. Linked Sites are not under Linksys' control, and Linksys is not responsible or liable for and does not endorse the content or practices of such Linked Sites, including any information or materials contained on such Linked Sites. You will need to make your own independent judgment regarding your interaction with these Linked Sites. You hereby waive and release any legal claim you might have against Linksys with respect to these sites or third-party products or services.

Indemnity: If Linksys is the subject of a claim, becomes involved in a legal proceeding, or suffers any economic loss or damage as a result of your violation of this Agreement, to the extent permitted by law, you will be responsible for compensating Linksys for the full amount of its loss, as well as any reasonable amounts Linksys incurs in lawyers' fees, expenses and court costs, except to the extent that Linksys contributed to the loss or damage.

Termination: If you fail to abide by the terms of this Agreement, we reserve the right to terminate this Agreement by written notice to you, in which case your right to use the Software terminates and you are required to stop using the Software. If the Software has been installed on a personal computer, you must uninstall the Software immediately. If the Software is firmware embedded on a Product, you must stop using the Product.

Limited Warranty:

Important Notice Regarding Your Consumer Rights: SOME COUNTRIES, STATES AND/OR PROVINCES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN CONDITIONS, WARRANTIES OR GUARANTEES, AND/OR DO NOT ALLOW PRODUCTS OR SERVICES TO BE SOLD WITH NO WARRANTIES OR GUARANTEES. ACCORDINGLY, IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THIS SECTION ENTITLED 'LIMITED WARRANTY' MAY NOT APPLY TO YOU. ONLY THOSE EXCLUSIONS AND LIMITATIONS THAT ARE LAWFUL IN YOUR JURISDICTION WILL APPLY TO YOU AND, IN SUCH INSTANCES, LINKSYS' LIABILITY WILL BE LIMITED ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW. The enforceability of these limited warranties may vary based on the local laws applicable to you, and you may have additional rights depending on where you live. For example, in Australia, our Software and the media on which it is provided come with statutory guarantees, including as to quality and fitness for purpose, which cannot be excluded or limited under the Australian Consumer Law (as further explained below).

This Agreement is not intended to and does not:

change or exclude any statutory consumer rights that cannot be lawfully changed or excluded; or
limit or exclude any right you have against the person who sold the Product to you if that person has breached any sales contract with you.

If you are located in Australia or New Zealand, the following paragraph applies to you:

Certain legislation, including the Australian Consumer Law and the Consumer Guarantees Act 1993 (New Zealand) may imply warranties or conditions, or impose guarantees or obligations on Linksys, which operate to protect certain Australian or New Zealand purchasers of goods and services in various circumstances ('AU/NZ Applicable Laws'). Nothing in this Agreement excludes, restricts or modifies any condition, warranty, guarantee, right or remedy implied or imposed by any AU/NZ Applicable Laws which cannot lawfully be excluded, restricted or modified. If any condition, warranty or guarantee is implied into this Agreement or imposed on Linksys under AU/NZ Applicable Laws and cannot be excluded, but Linksys is permitted by an AU/NZ Applicable Law to limit Linksys' remedy for a breach of such a condition, warranty or guarantee, then the liability of Linksys for breach of the condition, warranty or guarantee is limited to one or more of the following, at Linksys' option: (a) in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment of the cost of having the goods repaired; or (b) in the case of services, the supplying of the services again, or the payment of the cost of having the services supplied again.

Linksys warrants that any media (such as a CD or USB stick) on which the Software is provided will be free from defects in materials and workmanship under normal use for 90 days from the date of its original purchase (the 'Warranty Period'). If you make an eligible software media claim under this warranty, Linksys will honor this warranty by replacing the Software media. This Limited Warranty does not apply in Australia. Consumers in Australia have statutory rights in relation to the Software and media on which the Software is provided under the Australian Consumer Law.

EXCEPT FOR THIS LIMITED WARRANTY ON MEDIA, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, the Software is provided to you 'as is,' with all faults and without warranties of any kind. In particular, Linksys does not guarantee that the Software will be error-free or that the Software will be free from attack from computer viruses or other system threats. Linksys also does not warrant that the Software will meet your expectations or that the Software will be suitable for your particular purposes. Linksys does not guarantee that the Software will not infringe someone else's intellectual property rights.

IT IS YOUR RESPONSIBILITY TO BACK UP YOUR SYSTEM INCLUDING, WITHOUT LIMITATION, ANY DATA THAT YOU MAY USE OR POSSESS IN CONNECTION WITH THE PRODUCT. ANY MATERIAL, INFORMATION OR DATA DOWNLOADED OR OTHERWISE OBTAINED IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR PRODUCT, OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF SUCH MATERIAL, INFORMATION OR DATA.

General Exclusions and Limitations of Liability: In some jurisdictions and circumstances, it is possible to exclude and/or to limit Linksys' liability to consumers. Only in those jurisdictions where it can lawfully do so, and to the full extent that it is allowed by law to do so, Linksys:

limits all implied warranties and conditions of merchantability, acceptability, acceptable quality, satisfactory quality, quiet enjoyment or fitness for a particular purpose to the duration of the relevant Warranty Period;
excludes all express or implied conditions, representations and warranties, including any implied warranty of non-infringement, OTHER THAN THOSE EXPRESSLY PROVIDED TO YOU BY LINKSYS IN WRITING OR AGREED TO BY LINKSYS IN WRITING;
excludes all liability for the loss of, or damage to, data caused by use of a Linksys product, or its repair;
excludes any liability it may have to you for:
1. loss of revenue or profit,
2. loss of the ability to use any third party products, software or services, and
3. any indirect, consequential, special, incidental or punitive loss or damages,
which arises under any law and relates to your use, or inability to use the Software, or any related services. This exclusion applies even if Linksys has been advised of the possibility of such damages and even if any warranty or remedy provided under this limited warranty fails of its essential purpose; and
limits its monetary liability to you, under any law, to the price that you paid for the Product, the Software or the media device containing the Software.

Nothing in this Section shall limit the liability of Linksys in relation to death or bodily injuries.

IF YOU LIVE IN THE EUROPEAN UNION, REFERENCES TO 'SPECIAL, INDIRECT, CONSEQUENTIAL, PUNITIVE OR INCIDENTAL DAMAGES' SHALL MEAN ANY LOSSES WHICH

WERE NOT REASONABLY FORESEEABLE BY BOTH PARTIES;
WERE KNOWN TO YOU BUT NOT TO US; AND/OR
WERE REASONABLY FORESEEABLE BY BOTH PARTIES BUT COULD HAVE BEEN PREVENTED BY YOU SUCH AS, FOR EXAMPLE (BUT WITHOUT LIMITATION), LOSSES CAUSED BY VIRUSES, TROJANS OR OTHER MALICIOUS PROGRAMS, OR LOSS OF OR DAMAGE TO YOUR DATA.

Export Control Laws: You agree that the use of the Software is subject to U.S. and local export control laws and regulations. You represent that you are not a citizen of an embargoed country or a prohibited end user under applicable U.S. or local export and anti-terrorism laws, regulations and lists. You agree not to export, re-export, divert, transfer or disclose any portion of the Software or any related technical information or materials, directly or indirectly, in violation of any applicable export law or regulation.

U.S. Government Users: The Software and user documentation qualify as 'commercial items' as defined at 48 C.F.R. 2.101 and 48 C.F.R. 12.212. All Government users acquire the Software and user documentation with only those rights herein that apply to non-governmental customers. Use of either the Software or user documentation or both constitutes agreement by the Government that the Software and user documentation are 'commercial computer software' and 'commercial computer software documentation,' and constitutes acceptance of the rights and restrictions herein.

General Terms: If any portion of this Agreement or any of its terms is found to be void or unenforceable, the remaining provisions or any part thereof will remain in full force and effect. This Agreement constitutes the entire agreement between the parties with respect to the Software and supersedes any conflicting or additional terms contained in any purchase order or elsewhere. No changes to this Agreement will be binding unless in writing and accepted by Linksys and you. However, the contents of the Belkin Privacy Statement and/or the Linksys Smart WiFi Privacy Statement are subject to change in the manner described in those documents. Any waiver of any provision of this Agreement will be effective only if in writing and signed by Linksys. Any translation of this Agreement is done for local requirements and in the event of a dispute between the English and any non-English versions, the English version of this Agreement shall govern, to the extent not prohibited by local law in your jurisdiction.

If you are located in the United States, the following clauses apply to you:

Arbitration, Waiver of Classwide Arbitration, Governing Law & Venue: YOU AND LINKSYS EACH ACKNOWLEDGE AND AGREE THAT ANY CLAIM, DISPUTE OR CONTROVERSY BETWEEN YOU AND LINKSYS ARISING OUT OF OR RELATING TO (1) THIS AGREEMENT, INCLUDING THE VALIDITY OF THIS SECTION, AND (2) YOUR USE OF PRODUCT(S) UNDER THIS AGREEMENT (COLLECTIVELY, THE 'DISPUTE') SHALL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION ADMINISTERED BY A MUTUALLY AGREEABLE NATIONALLY RECOGNIZED ARBITRATION AUTHORITY PURSUANT TO ITS CODE OF PROCEDURES THEN IN EFFECT FOR CONSUMER-RELATED DISPUTES. YOU UNDERSTAND THAT WITHOUT THIS PROVISION YOU WOULD HAVE HAD A RIGHT TO LITIGATE A DISPUTE THROUGH A COURT BEFORE A JURY OR JUDGE, AND THAT YOU HAVE EXPRESSLY AND KNOWINGLY WAIVED THOSE RIGHTS AND AGREE INSTEAD TO RESOLVE ANY DISPUTES THROUGH BINDING ARBITRATION IN ACCORDANCE WITH THE PROVISIONS OF THIS SECTION.

THE ARBITRATION SHALL OCCUR BEFORE A SINGLE ARBITRATOR, WHO MUST BE A RETIRED JUDGE OR JUSTICE, IN ONE OF SIX REGIONAL VENUES CONSISTENT WITH THE VENUE PROVISION BELOW. WHETHER OR NOT YOU PREVAIL IN THE DISPUTE SO LONG AS YOUR CLAIM IS NOT FOUND TO BE FRIVOLOUS BY THE ARBITRATOR AS MEASURED BY RULE 11(b) OF THE FEDERAL RULES OF CIVIL PROCEDURE, YOU SHALL BE ENTITLED TO BE REIMBURSED FOR YOUR COSTS OF ARBITRATION, WITHIN THE SOLE DISCRETION OF THE ARBITRATOR. IF THE ARBITRATION AWARD IS EQUAL TO OR GREATER THAN THE AMOUNT YOU DEMANDED IN YOUR ARBITRATION CLAIM, LINKSYS WILL PAY FOR YOUR REASONABLE AND ACTUAL ATTORNEYS' FEES YOU HAVE INCURRED TO ARBITRATE THE DISPUTE, PLUS A MINIMUM RECOVERY OF $2,500. ANY DECISION OR AWARD BY THE ARBITRATOR RENDERED IN AN ARBITRATION PROCEEDING SHALL BE FINAL AND BINDING ON EACH PARTY, AND MAY BE ENTERED AS A JUDGMENT IN ANY COURT OF COMPETENT JURISDICTION. IF EITHER PARTY BRINGS A DISPUTE IN A COURT OR OTHER NON-ARBITRATION FORUM, THE ARBITRATOR OR JUDGE MAY AWARD THE OTHER PARTY ITS REASONABLE COSTS AND EXPENSES (INCLUDING BUT NOT LIMITED TO ATTORNEYS' FEES) INCURRED IN ENFORCING COMPLIANCE WITH THIS BINDING ARBITRATION PROVISION, INCLUDING STAYING OR DISMISSING SUCH DISPUTE.

NEITHER YOU NOR LINKSYS SHALL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS IN ARBITRATION BY OR AGAINST OTHER CONSUMERS OR ARBITRATE ANY CLAIMS AS A REPRESENTATIVE OR MEMBER OF A CLASS OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. YOU UNDERSTAND THAT WITHOUT THIS PROVISION YOU MAY HAVE HAD A RIGHT TO ARBITRATE A DISPUTE ON A CLASSWIDE OR REPRESENTATIVE BASIS, AND THAT YOU HAVE EXPRESSLY AND KNOWINGLY WAIVED THOSE RIGHTS AND AGREE INSTEAD TO ARBITRATE ONLY YOUR OWN DISPUTE(S) IN ACCORDANCE WITH THE PROVISIONS OF THIS SECTION.

NOTWITHSTANDING THE ABOVE AGREEMENT TO ARBITRATE DISPUTES, YOU AND LINKSYS EACH ACKNOWLEDGE AND AGREE THAT EITHER PARTY MAY, AS AN ALTERNATIVE TO ARBITRATION, BRING AN INDIVIDUAL ACTION IN SMALL CLAIMS COURT TO RESOLVE A DISPUTE, SO LONG AS SUCH SMALL CLAIMS COURT DOES NOT PROVIDE FOR OR ALLOW FOR JOINDER OR CONSOLIDATION OF CLAIMS.

THIS AGREEMENT IS TO BE CONSTRUED IN ACCORDANCE WITH AND GOVERNED BY THE INTERNAL LAWS OF THE STATE OF CALIFORNIA WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW RULE THAT WOULD CAUSE THE APPLICATION OF THE LAWS OF ANY JURISDICTION (OTHER THAN THE INTERNAL LAWS OF THE STATE OF CALIFORNIA) TO THE RIGHTS AND DUTIES OF THE PARTIES. HOWEVER, WITH RESPECT TO SOFTWARE PROVIDED, IF YOU ARE A CONSUMER AND YOU LIVE IN A COUNTRY WHERE LINKSYS MARKETS OR PROMOTES THE SOFTWARE, LOCAL LAW MAY REQUIRE THAT CERTAIN CONSUMER PROTECTION LAWS OF YOUR COUNTRY OF RESIDENCE APPLY TO SOME SECTIONS OF THIS AGREEMENT. EACH OF THE UNITED NATIONS CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS AND THE UNITED NATIONS CONVENTION ON THE LIMITATION PERIOD IN THE INTERNATIONAL SALE OF GOODS IS HEREBY EXPRESSLY EXCLUDED AND WILL NOT APPLY TO THIS AGREEMENT.

EXCEPT FOR INDIVIDUAL SMALL CLAIMS ACTIONS WHICH CAN BE BROUGHT IN ANY SMALL CLAIMS COURT WHERE JURISDICTION AND VENUE ARE PROPER, ANY ARBITRATION, LEGAL SUIT, ACTION OR PROCEEDING ARISING OUT OF OR RELATING TO THIS AGREEMENT OR ANY DISPUTE SHALL BE COMMENCED IN (1) NEW YORK, NEW YORK, (2) ATLANTA, GEORGIA, (3) CHICAGO, ILLINOIS, (4) DALLAS, TEXAS, (5) SEATTLE, WASHINGTON, OR (6) LOS ANGELES, CALIFORNIA, AND YOU AND LINKSYS EACH IRREVOCABLY SUBMITS TO THE EXCLUSIVE JURISDICTION AND VENUE OF ANY SUCH PROCEEDING. HOWEVER, FOR A DISPUTE OF $10,000 OR LESS, YOU MAY CHOOSE WHETHER THE ARBITRATION IN ANY OF THE SIX REGIONAL VENUES PROCEEDS IN PERSON, BY TELEPHONE, OR BASED ONLY ON SUBMISSIONS.

If you are located outside of the United States, the following clause applies to you:

Governing Law: This Agreement will be governed by California law, without reference to its or any other jurisdiction's conflict of laws principles. The state and federal courts of California shall have non-exclusive jurisdiction over any claim arising under, or in connection with, this Agreement. However, if you are a consumer and you live in a country where Linksys markets or promotes the Software, local law may require that certain consumer protection laws of your country of residence apply to some sections of this Agreement. Each of the United Nations Convention on Contracts for the International Sale of Goods and the United Nations Convention on the Limitation Period in the International Sale of Goods is hereby expressly excluded and will not apply to this Agreement.

BELKIN, LINKSYS and many product names and logos are trademarks of the Belkin group of companies. Third-party trademarks mentioned are the property of their respective owners.

Types of Information Covered by This Privacy Policy

Belkin may collect both Personal Information and Non-Personal Information. "Personal Information" means any information that can be used to identify you. Some examples of Personal Information include your name, address, email address and phone number. "Non-Personal Information" means information that on its own cannot be used to identify you. Some examples of Non-Personal Information include usage data relating to Belkin websites and Belkin Products, language preferences and Belkin website page views.

Information may be aggregated and/or anonymized. When information is aggregated, it is combined with information about other customers and users. When information is anonymized, Personal Information is removed from collected data and the remaining portion of the data, containing only Non-Personal Information, is repurposed for internal or external use, such as, for example, to determine how many users of a particular router include an Internet-enabled television in a home network environment, or how many users viewed a particular website video or advertisement. Aggregated information that includes Personal Information is considered Personal Information until it has been anonymized. Anonymized information is considered Non-Personal Information. In general, usage data collected when you visit Belkin websites or use Belkin Products is both aggregated and anonymized so it does not identify you personally and is therefore Non-Personal Information.

The Belkin websites and Belkin Products are not directed to, nor does Belkin knowingly collect Personal Information from children under the age of 13. If we are informed that we have collected the Personal Information of a child under the age of 13, we will delete that Personal Information from our systems. How We Collect Information

We may collect and process the following data about you:

Information you give us. If you fill in forms on Belkin websites or correspond with us by phone, email or otherwise, you may be providing us with information about you, which may include Personal Information. This includes information you provide when you register on Belkin websites, register or return a Belkin Product, subscribe to any of our services, search for a product, place an order on Belkin websites, participate in discussion forums or other social media functions on Belkin websites, enter a competition, promotion or survey, participate in a training session or other event, download firmware, software and apps, or when you report a problem with Belkin websites or Belkin Products or otherwise request support. Personal Information you give us may include your name, address, email address, phone number and other contact information, financial and credit card information and any other information that can be used to personally identify you.

Information we collect about you. We may automatically collect information when you use Belkin websites or Belkin Products, including:

Technical information, including the Internet protocol ("IP") address used to connect your computer or other device to the Internet, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform and language preferences. This information is all normally provided by your web browser, and we do not specifically request it.
Information about your visit to Belkin websites, including the full Uniform Resource Locators ("URL") clickstream to, through and from Belkin websites (including date and time); products you viewed or searched for; page response times; download errors; length of visits to certain pages; videos watched; page interaction information (such as scrolling, clicks, and mouse-overs); and methods used to browse away from the page.

Usage data about how and when you use Belkin Products, other devices that are connected to Belkin Products and what features of Belkin Products you use.
Technical information and data gathered when your Belkin Products are connected to the Internet, such as how many and which devices are connected to your home network, when you use the devices and the amount of network traffic generated. We also collect environmental data when you use certain Belkin Products, such as utility settings, temperature and light readings in the home, motion detection and alarm events.
If you consent, certain apps may collect information about your location. If you do not want this information collected, do not consent, or consult your device manual for instructions on how to change location settings.

Information we receive from other sources. We work closely with third parties who provide services to us (including, for example, business partners, subcontractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, credit reference agencies) and we may receive information about you from them.

How We Use Information

We may use the information we collect for a number of purposes. These purposes will be consistent with the reason you provided the information to us or for a directly related purpose. The uses we make of such information include the following:

To set up an account for you on Belkin websites or Belkin Products.
To facilitate your purchase and/or download of Belkin Products. To authenticate use of your account or purchases and/or use of a Belkin Product.

Sharing Information

Under no circumstances do we rent or sell your Personal Information to third parties for marketing purposes. We only share your Personal Information with third parties for marketing purposes if you have granted us permission to do so. We will ask for your consent, such as by email response, opt-in box or click through agreement acceptance, before we use or share your Personal Information for any purpose other than the reason you provided it or as otherwise provided by this Privacy Policy. We may share Personal Information in the following ways:

Within Belkin for purposes of data processing or storage.
Within Belkin's corporate group, including with our subsidiaries, affiliated companies and divisions, all of whom may use your information for the purposes disclosed in this Privacy Policy.
With business partners, service vendors, authorized third-party agents or contractors to provide a requested service or transaction, including processing orders, hosting websites, storing your information, providing email communications on our behalf and providing customer support. We only provide these third parties with the minimum amount of Personal Information necessary to complete or provide the requested service or transaction, and we do not allow third parties to use your Personal Information for a different purpose than what was disclosed to you.
With service providers, advisors or other third parties to the extent reasonably necessary to proceed with the negotiation or completion of a merger, acquisition or sale of all or a portion of our assets. If Belkin merges with or acquires or is acquired by another entity, Personal Information would be transferred as a whole to the successor entity.
To comply with the law or legal process (such as responding to subpoenas or court orders), to comply with government reporting obligations and to exercise our legal rights or defend against legal claims.
To protect our legal rights or those of others, such as protecting the Belkin brand or investigating violations of Belkin terms of use, violations of law, intellectual property infringement, misuse of Belkin websites, fraud or potential threats to personal safety.

In addition, we may share aggregated and anonymized Non-Personal Information, including usage data about Belkin Products, with third parties for a variety of purposes, including to analyze trends about home networking and utility use, to show third parties how their products could work with Belkin Products and to generally improve home networking. We've taken steps to ensure that this information cannot be linked back to you and we require third parties to keep all shared information in its anonymized form.

For certain WeMo and Linksys Smart Wi-Fi products, Belkin may provide the opportunity for you to connect and interface Belkin Products with one or more third party products and services, which will involve the exchange of information from your Belkin Product with the third party product or service. Your explicit consent and authorization will be required at the time of connection to the third party product or service, and will be revocable by you at any time. In some cases, if you purchase, use or download a third party product or service that connects to a Belkin Product, you may also be subject to such third party's privacy policy. Belkin is not responsible for the privacy practices of third party partners. If you access a Belkin Product through a third party product in this manner, you consent and agree to the privacy policy of such third party. We encourage you to carefully read the privacy policies and terms of use of any third party products that connect to Belkin Products.

Any third parties with whom we share your Personal Information are required to maintain the confidentiality of the information and are prohibited from using it for any other purpose. We will take all reasonable steps to make sure these third parties comply with the same privacy principles that govern our collection of your personal information.

When making purchases on the Belkin website stores, Belkin uses a payment processor to verify your payment card information. Your payment card information is passed through to the payment processor and is not collected or stored by Belkin. The payment processor is authorized to use this information only to authenticate your purchase and for no other purpose.

Our European website stores are operated by a third-party service provider, Trojan Electronics Ltd. ("Trojan"). Trojan processes your Personal Information solely for the purpose of fulfilling orders placed on our Belkin website stores in Europe, and in accordance with European data protection law.

Marketing

You have the right to ask us not to process your Personal Information for marketing purposes. We will inform you (before collecting your Personal Information) if we intend to use your Personal Information for marketing purposes, or if we intend to disclose your Personal Information to any third party for marketing purposes.

We will always give you choices about your Personal Information. Some choices are presented up front in the form of Opt-in notices or acceptance boxes for marketing to you or sharing your Personal Information with third parties. In certain cases where permitted by law, we also may give you the choice to Opt-out. "Opt-out" means you have already chosen to Opt-in, but you later change your mind. One form of Opt-out is clicking the Unsubscribe link in a marketing email. This will take you off of our marketing email list. Belkin's general policy is to have users Opt-in, rather than Opt-out, to receive marketing information and to allow the sharing of information with third parties. Please note that these Opt-in/Opt-out choices do not apply to the receipt of mandatory website, service or software communications, such as update or downtime information, or receipt of order or shipping confirmations on Belkin website stores, which you may receive periodically unless you cancel your service or order or terminate use of software in accordance with the applicable terms of use or license agreement.

New Belkin Products

When you purchase and/or download new Belkin Products, we will only use your Personal Information for the purposes set out (i) in this Privacy Policy and (ii) in any notification provided to you at the time of purchase or download.

Where We Store Your Information

The data that we collect from you may be transferred to, and stored at, various locations globally, including the United States. It may also be processed by Belkin staff or contractors operating outside your country of residence (including, if you are in Europe, outside of the EEA, or, if you are in Australia or New Zealand (ANZ), outside of ANZ) who work for us or for one of our suppliers. Such staff may be engaged in, among other things, the fulfilment of your order, the processing of your payment details and the provision of support services. We also use cloud-based applications and services to store and process your Personal Information, which may result in your Personal Information being stored outside your country of residence (or the EEA or ANZ).

We will take such steps as are reasonable to make sure we and our service providers do not breach the privacy principles that govern our collection of your personal information. By providing your Personal Information to us, you fully understand and consent to the transfer, processing and storage of Personal Information outside of your country of residence where data protection standards may be different, and yo consent to disclosure and use of your Personal Information to overseas service providers who may not fully comply with the particular laws of your country. Our Privacy Policy and our practices are designed to provide a globally consistent level of protection for Personal Information all over the world. This means that even in countries whose laws provide for less protection for your information, Belkin will still handle your information in the manner described in this Privacy Policy and in conformity with all applicable laws.

Accessing and Updating Your Personal Information

We need your help in keeping your Personal Information accurate and up to date, so please notify us of any changes to your Personal Information. You can access and update your Personal Information and communication preferences at any time in the following ways:

By sending an email to privacy@belkin.com. Please be sure to include your name, email address and specific relevant information about the information you would like to change or the material that you no longer wish to receive.
For many Belkin websites and Belkin Products, by signing in to your online account located at the URL provided when you signed up for the Belkin website or service.

We will honor your reasonable request to:

Correct your data if it is inaccurate.
Transfer your Personal Information to a third party.
Delete your Personal Information, unless we are required to retain it by law.
Provide you with a copy of Personal Information held on our current records at no charge, or for a reasonable charge if records must be accessed from backed up or archived records.

We will respond to your request promptly upon receipt. We may ask you to verify your identity before we can act on your request. If your Personal Information has been disclosed to a third party in accordance with this Privacy Policy, we will take reasonable steps to notify the third party of any updated information you provide to us.

We note again that, if you choose to no longer receive marketing information from us, we may still communicate with you about other matters, such as product and service updates for Belkin Products you have purchased and customer support matters.

Retention of Personal Information

We will only retain your Personal Information to fulfill the purposes for which it was collected or as required for legitimate business purposes as described in this Privacy Policy or otherwise as permitted by law.

Cookies, Web Beacons and Other Web Tools

We use automatic data collection tools like cookies, embedded web links and widgets (collectively, "web tools"). These web tools collect certain information that your browser or your mobile device sends to Belkin websites and Belkin Products, such as computer IP address, browser type and service provider. In addition, Belkin uses small pieces of code called web beacons. Web beacons allow a website to transfer or collect information through a graphic image request. This allows Belkin to collect information such as the address of the page you are visiting, the address of the referring page you previously visited, what browser or mobile device you are using, and your display settings. Belkin and its advertising partners use web beacons, for example, to find out if advertising on Belkin websites and other websites that contain Belkin ads is effective, or if certain videos on Belkin websites are being viewed.

Belkin may use web tools for the following purposes:

To identify the user's country and language and distinguish you from other users of Belkin websites.
To save your registration information for future use on Belkin websites and services.
To allow customer surveys to appear or not appear to customers.
To optimize your browsing experience by preloading certain features of Belkin websites and services on future visits to make loading times faster and more efficient.

You have the following choices regarding Belkin's use of web tools:

You may refuse to accept cookies by activating the appropriate setting on your browser or mobile device. However, many features of Belkin websites and Belkin Products may not work as intended if you disable cookies, and areas that require registration or authentication and Belkin website store transactions will not be accessible.
For some Belkin Products, you can go into the account settings and select an option that will remove you from personalized advertising. If you select this option, you will receive generic advertising as part of these Belkin Products rather than advertising that has been tailored based on your preferences.
Many advertising companies are members of the Digital Advertising Alliance or the Network Advertising Initiative and provide opt-out choices on their websites.

We do not currently respond to web browser "do not track" signals or other mechanisms that provide a method to opt out of the collection of information across the networks of websites and online services in which we participate. In addition to Belkin's use of web beacons on Belkin websites, we allow certain third parties who provide Belkin advertising on their websites to use their own web beacons within Belkin websites. In that case, if you click on or view a Belkin ad on one of our advertising partners' websites and are redirected or go to the Belkin website, the advertising partner places a web beacon on your browser so that we can track advertising conversions (which let us know if an ad was effective). These web beacons will appear on your browser regardless of whether you have refused to accept cookies or indicated that you do not want to be tracked on Belkin websites or on the Internet generally. However, they are only used by Belkin for the limited purpose of tracking advertising conversions and do not identify you personally in any way.

Third parties may collect information about your online activities over time and across different websites when you use Belkin websites. To avoid tracking by these third parties, you can exercise the choices above to reject cookies, although Belkin has no control over and cannot confirm whether these third parties honor the do not track browser choices you have made.

Security

We strive to maintain reasonable administrative, technical and physical safeguards designed to protect the information collected by Belkin websites and Belkin Products. Unfortunately, the transmission of information via the Internet is not 100% secure. Although we will do our best to protect your Personal Information, we cannot guarantee its security; any transmission is at your own risk.

It is important to note that if you use a computer or device that can be accessed by others, other people may be able to access unencrypted Personal Information. If you do not want your information to be available to others, exercise caution when using public computers or devices or when using any computer or device to which users unauthorized by you may have access.

Updates and Upgrades

Belkin Products may be updated or upgraded from time to time to provide additional features, address technical issues, and generally make your user experience better. Some Belkin Products include an auto-update feature, which gives us the ability to make updates automatically. You can change auto-update options by changing your settings within the Belkin Product account information. In very limited cases, updates may still be automatically applied, regardless of the auto-update setting. For example, we may provide an automatic update that prevents or fixes a security vulnerability or breach to your network.

Third Party and Social Media Linked Sites

Belkin websites and online services may contain links to websites or online services operated by third parties. Belkin Products may also use or offer products and services from third parties, such as a third party app that works with a Belkin Product. Once you leave Belkin websites and Belkin Products, your activities are governed by the terms of use and privacy policies of the third party websites and online services. Belkin is not responsible for the privacy practices or the content of these websites and online services, and we encourage you to carefully read the terms of use and privacy policies of any website and online service you visit.

Belkin websites and Belkin Products may contain social media features, such as Facebook "Like" buttons. These features may collect information about your device's IP address, set cookies to facilitate interaction with social media features or link you to a social media website where you may post Personal Information. All interactions with social media features are governed by the privacy policy of the social media company providing the feature.

Forums/Chat Rooms

If you participate in or post information to a discussion forum or chat room on any Belkin website or Belkin Product, you should be aware that the information you provide there will be made broadly available to others, and can be read, collected, forwarded or used by other users of these forums, potentially inside or outside Belkin, who have access to that forum.
